The appeals herein were submitted on the 22d day of April, 1909, and an opinion of the court deciding the same was handed down on the 7th day of May, 1909. 116 N. Y. Supp. 767. The determination of the surrogate was reversed, in part, by a modification of the decree, in part, and directing a rehearing thereon, with a stay of proceedings.
