Plaintiff based its action on section 5448, Revised Statutes 1909, alleging that defendant committed trespasses in cutting and carrying away certain grrowing timber which belonged to plaintiff.
The petition is in two counts, the charge being substantially the same in each except as to'the description *376of the lands on which the timber was growing. The first count relates to trespasses on section 35, township 24, range 8 east, and the second relates to trespasses on the north half of the northeast quarter of section 21, township 20, range 8, all in Butler county, Missouri.
