Patton v. Dallas Gas Co.

Error to the Court of Civil Appeals for the Fourth District, in an appeal from Dallas County. Patton sued the Dallas Gas Company for personal injuries, and recovered judgment. He obtained writ of error when, on defendant’s appeal, the judgment was reversed and rendered in its favor.

This suit was for personal injuries sustained by the plaintiff in error, Will D. Patton, in falling through an opening in the floor of the Dallas-Gas Company’s main building into the basement thereof. The opening through which he fell had no guard rail around it, but was entirely unguarded and unprotected against accidents such as the one which happened in this case. The opening in the floor was in the room of the gas company’s building known as the “stoking room.” At its side a stairway went from the stoking room to the basement.
