MEMORANDUM OPINION AND ORDER

HOLWELL, District Judge.

The New York City Department of Information Technology & Telecommunications (“DoITT”) (hereinafter, “City”) filed two proofs of claims in this confirmed Chapter 11 bankruptcy case, seeking fines in connection with the operation of public pay telephones by debtor Best Payphones, Inc. (“Best”). On October 6, 2005, Best moved to withdraw the reference of the part of its objection based on the federal Telecommunications Act of 1996 (“TCA”), 47 U.S.C. § 251 et seq., in particular 47 U.S.C. §§ 253(a) and (c).
