Memorandum Opinion On Motions To Suppress And Dismiss Indictment

Defendants Reyes, Cordero and Burgos have been charged in a two count indictment with a violation of 21 U.S.C. § 176a which makes it a crime to deal in or possess illegally imported marihuana.

It is charged in count one that on or about April 26, 1967, defendants, “unlawfully, wilfully and knowingly, and with intent to defraud the United States, did receive, conceal and facilitate the transportation and concealment of a quantity of marihuana * * * [851 grams] knowing the same to have been imported and…
