This action was brought to recover *463damages for breach of contract of employment. The defendant agreed to employ the plaintiff, as a traveling salesman, upon certain terms mentioned in the agreement. He was discharged before the expiration of the contract for alleged cause.
At the close of the plaintiff’s testimony defendant’s counsel moved to dismiss the complaint upon the ground that the defendant had a right to discharge the plaintiff if, in his judgment, he was incompetent.
