The appellee, G-. H. Nantz, and W. 0. Barr jointly and equally owned the fee-simple title 'to a tract of land in Daviess county, Ky., near Owensboro, containing 140 acres. On January 29,1918, they borrowed $10,000 from the appelle and plaintiff below, Federal Land Bank of Louisville, Ky. (hereinafter referred to as the bank), and executed a mortgage on the entire tract to secure the notes executed in evidence thereof.
