The majority of this court, speaking through Judge Harper, have delivered two elaborate opinions upon the questions involved in this case, devoting over fifty typewritten pages to the discussion of same; and it is with some regret that I feel called upon to dissent from the conclusions reached by the majority. That regret is based upon the profound conviction that the decision is unsound, and does violence to the Constitution, and to the fundamental principles of our government.
