This is an action of assumpsit, instituted in the Circuit *587Court of Pleasants County, by the children and heirs at law of J. L. Isreal, deceased, against W. P. Jones. A demurrer to the declaration and each count, thereof, was interposed, by the defendant, and the demurrer was overruled by the court, and the declaration is certified here to ascertain, from this court, whether or not the lower court erred in overruling the demurrer.
