MEMORANDUM OPINION
(October 5, 2009)
On November 19, 2008, the jury returned a “Guilty” verdict on all five (5) counts of the Amended Information against the Defendant Craig Francis. Immediately upon the jury’s discharge, counsel for the Defendant, Ariel M. Smith, Esq., made an oral motion for a new trial based on ineffective assistance of counsel. Thereafter, trial defense counsel submitted a written motion for new trial. The People opposed the motion.
