The Georgia Bailway and Electric Company, the main defendant in this case, was incorporated as a street and sub*131urban railroad. After obtaining its original charter, it sought and obtained from the secretary of State an amendment thereto, purporting to give it the right to run a branch line from Bast Point to Hapeville through the property of the plaintiff and others.
