In a proceeding pursuant to CPLR article 78 to review a determination to terminate the employment of the petitioner as a part-time code enforcement officer for the City of Middle-town Department of Public Works, the appeal is from an order and judgment (one paper) of the Supreme Court, Orange County (Marx, J.), dated December 30, 2013, which, after a hearing, denied the appellants’ cross motion to dismiss the proceeding, granted the petition, and annulled the determination.
Ordered that the order and judgment is affirmed, with costs.
