The plaintiff, the Citizens Electric Illuminating Company, has been for years engaged in developing electricity and supplying light, heat and power to the public in the Township of Jenkins in the County of Luzerne. Within the same territory exists another electric company, the Jenkins' Electric Light, Heat and Power Company, chartered for like purpose, but later, which has as yet constructed no plant for the production of electricity, and has no present purpose of constructing such plant.
