Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered May 22, 2008, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the fifth degree.
Defendant entered an Alford plea of guilty to criminal sale of a controlled substance in the fifth degree and was sentenced as a second felony offender to IV2 years in prison followed by two years of postrelease supervision.
