Donald English, a federal prisoner, appeals his sentence of 24 months of imprisonment for violating the terms of his supervised release. This case presents an issue of first impression in our circuit— whether a defendant, who was convicted under the Assimilative Crimes Act (“ACA”), 18 U.S.C. § 13, and who has served the state statutory maximum term of incarceration, may be sentenced to further imprisonment upon revocation of his supervised release.
