Appeal from an order of the Supreme Court (Keegan, J.), entered February 7, 2000 in Albany County, which, inter alia, granted defendant’s motion for summary judgment dismissing the complaint.

On April 20, 1996, plaintiff allegedly sustained serious *851injuries when the vehicle he was operating was struck from behind by a vehicle operated by defendant. As a consequence, plaintiff commenced this lawsuit in June 1997 alleging that he had sustained a serious injury as defined by Insurance Law § 5102 (d).
