The petition in this case sets forth, that on the 25th day of February 1853, the Fraternal Mutual Insurance Company, a corporation created by the laws of Ohio, issued a policy of insurance to Bichard H. Lee, whereby, in consideration of $29.50 then paid, and of the annual premium of $114, to be paid upon the 25th day of February in each year thereafter, they agreed to insure the life of said Lee, for the sole use and benefit of the plaintiff, his wife, for the term of seven years thereafter, in the sum of $5000, to be paid to her, in the event of his death *218during said period,…
