Appeal by the defendant, Louis H. Blakeman, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 27th day of December, 1898, upon the decision of the court rendered after a trial at the Hew York Special Term.

The action was brought to specifically enforce an agreement made between Louis H. Blakeman, the appellant, as party of the first part, *373Eleanor L. Blakeman, his wife, as party of the second part, and the plaintiff, Thomas Greenleaf, as trustee, party of the third part. The parties of the first and second part were husband and wife, but before the execution of the agreement they had separated and were living apart.
