MURNAGHAN, Circuit Judge:
The case presents us with two questions: (1) whether the district court below had jurisdiction to issue a declaratory judgment regarding the amount of uninsured motorist insurance available to an insured prior to the adjudication of liability against the underinsured tortfeasor; and (2) whether the district court was correct in holding that the insured failed to reject the default level of coverage imposed by Virginia’s Uninsured Motorist Law. Answering both questions in the affirmative, we affirm the judgment of the district court.
