No testimony was taken or sought to be taken under the present petition and answer, and none seems to have been necessary. The facts to which the appellee referred in his answer as justifying his non-payment were the facts that had already appeared in testimony, and upon which the decree of divorce was based; and although this testimony has been very properly omitted from the record now before us, the tenor of it sufficiently appears from the opinion rendered by the court at the time when the decree of divorce was entered.
