On the 30th day of January, 1888, the Georgia Southern & Florida Railroad Company executed and delivered to the Mercantile Trust & Deposit Company of Baltimore, as trustee, a mortgage to secure the payment of certain bonds issued by the mortgagor. This mortgage was duly recorded, and purported to create a lien “ on all the property, franchises and rights of said railroad company, and on its income, rents and profits.” Certain creditors of the Macon Construction Company instituted against it in the superior oourt of Bibb county an equitable petition under which, on the 14th day of March, 1891,…
