Ahmer v. Peters

This action was brought to foreclose a claim for a mechanic’s lien for balance of contract price for the construction of a residence, and certain extras.

The defendants filed their answer which alleged, among other things, that plaintiff had been discharged by reason of his failure to complete the work in the time required under the contract, and for the further reason that he imposed as a condition to the continuation of the work, payment of certain alleged extras, contained in his complaint.
