Cornelius brought an action against the Atchison, Topeka & Santa Fe Railway Com*600pany to recover damages alleged to have been sustained by the failure of the company to deliver cattle shipped over its line from Augusta, Kan., to Chicago, 111., in accordance with the agreement of the parties and its duty in the premises.
