This proceeding is pursuant to section 115-a of the Surrogate’s Court Act to compel the surety to pay the *164amount surcharged against the trustees by decree of this court-made May 3, 1943, for the sum of $164,042.73. This sum is segregated as follows: (1) to Theodore Carpenter interest of remainder, $84,939.33; (2) interest, $67,476.67; and (3) to J. F. Carpenter, III, interest on principal, $11,626.73.

Petitioner, as administrator of the estate of J. Fairfield Carpenter, III, has made a separate application praying that summary judgment for the said sum of $11,626.73 with interest…
