Lumpkin, Justice.

The bill of exceptions recites that there came on to be beard in tbe court below “ a cause in which Maggie L. *761George was the plaintiff, and the Georgia Southern & Florida Railroad Co. was defendant, the same being a motion fór a new trial then and there pending in said court, in behalf .of the defendant,” and that the motion was overruled. The only error complained of is the judgment overruling this motion, and yet, in specifying the material portions of the record to be sent up to this court, the motion itself is omitted entirely.
