MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

Namik Erdil (“Erdil” or the “petitioner”) by petition dated November 2, 2000, sought to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255. In a prior decision rendered on November 15, 2002 (United States v. Erdil, 230 F.Supp.2d 292 (E.D.N.Y.2002)) this court denied all parts of the petition except the issue of cooperation. The Court reserved decision on the petitioner’s contention that the Government acted in bad faith when it declined to give him a cooperation 5K1.1 letter.
