This is an appeal by the plaintiff from a judgment dismissing his complaint on, the merits after trial, and from an order denying his motion to retax costs of $725.80 which the judgment awarded to the defendants. The action was brought against Kings County Trust Company, hereafter for brevity called the Bank, and William Howard Barber. Federal jurisdiction was based on diverse citizenship.
