This is an appeal from a judgment of conviction and sentence of the defendant-appellant by the Court of Common Pleas of Defiance County for the offense of aggravated murder with a firearm specification.
On February 20, 1986 at about 11:30 a.m., the city Police Department of Defiance, Ohio, received an emergency call requesting assistance at 1221 Shawnee Drive in that city. The call was made by the defendant, Teresa Booher, who informed the police that her husband, Gary Booher, a patrolman on the Defiance police force, had been shot.
