This is an appeal from the judgment of the district court of Carter county in favor of the defendant in error against the plaintiff in error. The cause was submitted to, and the issues tried to the court without the intervention of a jury. Upon the request of the plaintiff in error, plaintiff below, the court made finding of facts in said cause and rendered judgment thereon on the 3rd day of February, 1926.
