In an action to recover damages for personal injuries, the plaintiff appeals from (1) an order of the Supreme Court, Kings County (Shaw, J.), dated June 29, 1999, which granted those branches of the respective motions of the defendants Frank Pelegrino and Atlas Material Co., Inc., which were pursuant to CPLR 3211 (a) (7) to dismiss the complaint insofar as asserted against them, and (2) an order of the same court (Pincus, J.), dated February 23, 2000, which denied his motion for reargument.
