COLLET, Circuit Judge.

This is an appeal in forma pauperis from an order denying appellant’s motion to vacate a judgment and sentence whereby, on his plea of guilty, he was sentenced to a term of five years imprisonment upon each of nine counts of an indictment, to run concurrently.

The indictment was in ten counts and was returned on September 7, 1948, by a grand jury in the Northern District of Iowa. *920Counts I and II charged the passing of certain United States postal money orders upon which there was a forged material signature, and Counts III to VIII charged the forgery of material…
