i. practice: hence.'. This cause was decided at the last June Term, and is reported in 20 Iowa, 477. A petition for rehearing was afterward filed, and a rehearing granted, The cause has been again ably argued, and upon reconsideration, we feel constrained to adhere to our former decision. The first question we are called upon to determine is as to the showing made by the bill of exceptions. In the first place, it will be remembered that there was a motion for a new trial on the ground, among others, of newly discovered material evidence, and also of accident, surprise and fraud.
