The plaintiff, Medical Modalities Associates, Inc. (Medical Modalities), a Delaware corporation, appeals from an order of the Circuit Court of Cook County which allowed the defendant, Henry B. Quick, to recover attorney’s fees and expenses under sections 41 and 57(5) of the Civil Practice Act. The text of these sections provides:
