On February 15, 1935, R. J. Nitkey and Lillian F. Nitkey, his wife, residents in and citizens of Illinois, brought this suit in equity in the District Court for the District of Minnesota against S. T. McKnight Company, Wentworth & Griffith, Inc., Colyer G.
