In a proceeding pursuant to CPLR article 78, petitioner appeals from a judgment of the Supreme Court, Dutchess County (Ritter, J.), dated March 26, 1981, which dismissed his petition to (1) vacate a parole violation warrant lodged against him and (2) restore him to parole. Judgment reversed, without costs or disbursements, and matter remitted to the respondent Parole Board for further proceedings in accordance herewith. On June 20, 1973 petitioner was sentenced under the name of Henry Hanson to two concurrent prison terms of 0 to 8 years and 0 to 7 years, after his convictions for the crimes…
