The defendant was indicted for the offense of armed violence, was tried before a jury, found guilty, and thereafter was sentenced to the penitentiary for a term of two years.

To reverse the judgment of conviction defendant contends (1) that the evidence is not sufficient to establish the defendant’s guilt beyond a reasonable doubt and that the verdict is contrary to the manifest weight of the evidence, (2) that the state’s attorney in his rebuttal closing argument committed error by commenting upon the failure of the defendant to call a certain witness, (3) that the penalty provisions…
