HISTORY OF THE CASE

This is a worker’s compensation case in which plaintiff, Clifton Durgin, is seeking permanent and total disability benefits, including penalties and attorney fees, from his employer, Oilfield Enterprises, Inc., and its worker’s compensation insurer, Western Preferred Insurance Company. The plaintiff had originally cited American Excess Underwriter’s, Inc. as the worker’s compensation insurer but later substituted the defendant’s actual compensation insurer, Western Preferred Insurance Company.
