“They, said F. H. Paschall, W. F. Stevenson and P. L. Whalen, and each of them, in the county of King, state of Washington, on or about the 26th day of March, 1938, while unlawfully and feloniously engaged in the commission of and in an attempt to commit a felony, to-wit: assault in the second degree, then and there wilfully, unlawfully and feloniously did strike and beat one Berry Lawson, a human being, thereby mortally wounding said Berry Lawson, from which said mortal wounds the said Berry Lawson then and…
