Tbe petition shows that on tbe 24th October, 1891, tbe complainants filed a bill in this court showing, among other things, that they possessed tbe title to and dominion over certain lands, which then were a part of the public domain of the United States* and described as the N. E. \ of tbe N. W. ⅛ and S. E. | of the N. W. ⅞, section 15, township B N., range 4 W., in Washington county, Ala., and that tbe defendant, with others, bad unlawfully cut timber upon said land, and made excavations and built ungainly embankments thereon, in tbe building and construction upon…
