In addition to the facts stated in the opinion, the bill further states that the defendant, Bad-ham, has commenced suit against the complainants in the city court of Bessemer on one of said purchase money notes and has commenced suit in the circuit' court of Jefferson county to enforce the collection of another of said purchase money notes.
