WATSON, J.

This was an action of assumpsit to recover from the defendants the sum of $375, the balance alleged to be due to plaintiff for the rent of certain premises situate on Hotel street in Honolulu for the months of July, August, September and October, 1915, the defendant Nakamura being plaintiff’s lessee, and the remaining defendants subtenants *262of said Nakamura. The declaration is in three counts as follows:
