A preliminary question raised by the motion of the attorney general to dismiss the appeal because the record was not lodged in the clerk’s office of this court within sixty days after the judgment was rendered must be disposed of.

Section 342 Criminal Code confers appellate jurisdiction on this court in prosecutions for misdemeanors in the cases therein named; and section 343, Ibid., provides that the appeal shall be prayed during the term at which the judgment was rendered, and shall be granted upon the conditiori that the record is *221lodged in the clerk’s office of the Court of Appeals within…
