This is the second appearance of this case in this Court. In 1994, James Daniel Taylor was convicted by a jury of possession of cocaine and, because this was his fourth felony conviction, sentenced to 25 years imprisonment without possibility of parole. In Taylor v. State, 1 we affirmed his conviction. Taylor now appeals the denial of his motion to correct an illegal sentence, arguing that: (1) the notice of aggravation of sentence did not survive his acquittal of possession of cocaine with intent to distribute; (2) notice that the State would seek recidivist…
