This case presents issues concerning the existence and scope of a prosecutor’s duty to present exculpatory evidence to a grand jury. After a jury trial, defendant was convicted of armed robbery, robbery, armed burglary, burglary, and possession of a weapon for an unlawful purpose. The Appellate Division reversed defendant’s convictions, concluding that the trial court should have dismissed the indictment because the prosecutor had failed to present to the grand jury evidence that the State’s principal witness had retracted her complaint…
