This is an action of summary process under G. L. (Ter. Ed.) c. 239, § 1, as amended, to recover possession of an apartment occupied by the defendant as a tenant at will of the plaintiffs. The writ was dated November 1, 1948, returnable to the Municipal Court of the West Rox-bury District of the' City of Boston, and on appeal to the Superior Court the case was heard by a judge without a jury. The judge denied certain requests of the defendant for rulings and made a finding for the plaintiffs for possession; and the action comes here on a bill of exceptions of the defendant.
