This case was tried with considerable care in the court below, and was in most respects well tried. Some questions, however, were raised and considered on the trial which were not necessarily involved, and which hindered, rather than helped the court and jury in reaching a correct result. For this reason, and because the case as it is presented is one of considerable' general importance, it seems desirable that the position of the parties, and the principles by which their relative rights are to be adjusted, should be briefly considered.
