Prior to January 30, 1904, the appellant, H. A. Williams, and one Little were partners, located at Owensboro, Kentucky, and 'engaged in speculating in real estate. At that time they were owners of several valuable pieces of real estate in Daviess county, Kentucky, and a tract of land containing something near one thousand acres in Ballard county, Kentucky.
