The defendant, L. C. Rogers, was indicted in the Superior Court of Murray County for the larceny of 300 pounds of D. P. & L. cotton, the property of J. C. Smith and of the value of $45. The defendant was tried, convicted, and sentenced. His motion for. a new trial was overruled, and he excepted. The jury was authorized to find: The prosecutor, J. C. Smith, had had some cotton stolen from him on the night of October 7, or during the early morning of October 8, before 7 o’clock, at which time he discovered his loss; that the cotton had been picked on the 7th and had been left in the field in…
