FRASER, Justice.

This is a suit for personal injuries sustained by appellant as the result of his having been'struck by the boom of a drag-line as it fell during lifting operations being performed in connection with the erection or installation of certain equipment in Borden County, Texas.

At the close of the evidence, the case was withdrawn from the jury by the trial judge, and judgment entered for defendant.
