In December, 1836, Earkin Eitchfield with Thomas James, and two others as his sureties, entered into a bond before the County court of Mathews county, as *g-uardian of the six children of Charles Atkinson deceased, of whom one was Mary Iy. The facts of this case are simple and un contested. In December, 1836, Larkin Litchfield having qualified and given bond with security as guardian of Mary Atkinson, placed her, being then of fender years, with her relative Mrs. Ann Frost in the city of Norfolk, for education and support. He defrayed her charges to the year 1839; and afterwards gave three several bonds on settlements, respectively, of the 27th August, 1840, 18th February, 1841, and 14th day of April, 1843.
